New 10/3/2022 - The U.S. Supreme Court has granted certiorari in Perez v. Sturgis Public Schools. The SCOTUS Blog website reports the issues as: "(1) Whether, and in what circumstances, courts should excuse further exhaustion of the Individuals with Disabilities Education Act's administrative proceedings under Section 1415(l) when such proceedings would be futile; and (2) whether Section 1415(l) requires exhaustion of a non-IDEA claim seeking money damages that are not available under the IDEA."

This case is expected to clarify the 2017 ruling in Fry. It may impact the "favorable public policy" of settlement agreements since the IDEA issues, in this case, were settled and not litigated.

9/21/2022 - Class action Complaint against Fairfax County Sch. Bd. and Virginia Dept. of Ed. alleges that from "2010 through July 2021 less than 1% of parents who initiated a due process hearing under the IDEA in Northern Virginia received a favorable ruling." Parents prevailed in 3 of 395 cases. Statewide parents prevailed in 13 of 847 cases. Over 20 years, "two thirds of the hearing officers have never ruled in favor of parents, not even once" [because the Virginia Department of Education] "carefully curated a group of twenty-two (22) hearing officers who nearly always rule in favor of school districts and against parents."

If the facts as alleged in the exhibits are true, this deliberate tilting of the scales of justice against children with disabilities is an affront to our system of justice and principles of due process.

10/6/2022 Update - Summonses were issued on September 23. Defendants must file a responsive pleading to the Complaint within 21 days after receipt of the summons. No responsive pleadings are on file with the District Court at this point.
